Acceptance of Terms

This Terms of Service document is an agreement you must accept to use DevTalenty.com Services. This is a legal agreement ("Agreement") between You and DevTalenty.com, which operates as DevTalenty.com, for the use of any DevTalenty.com services that You have selected or initiated. "You" refers to the individual who registered and/or provided their credit card or another payment mechanism on the DevTalenty.com website for the Services or, if the Services are purchased on behalf of an entity by an authorized individual, then "You" refers to that entity.

If you enter into this agreement on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these terms. In that case, "You" will also refer to that entity, its personnel, and its affiliates, as applicable. If you do not have such authority or do not agree with these terms of service, you may not use the Service.

You acknowledge that these terms of service constitute a contract between you and DevTalenty.com, even though it is electronic and not physically signed, and it governs your use of the Service.

Violation of any of the terms may result in the termination of your account.

Services

The Company may, at its sole discretion, modify the features of the DevTalenty.com Services from time to time without prior notice. DevTalenty.com reserves the right at any time and from time to time to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice. You agree that DevTalenty.com shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

If any user submits feedback or suggestions regarding the Service, they grant DevTalenty.com an unlimited, irrevocable, perpetual, and royalty-free license to use such feedback or suggestions for any purpose without any obligation to you.

Access to Services

You will receive a password and an account designation upon completing the Service registration process. You are responsible for maintaining the confidentiality of your password and account and are fully responsible for all activities that occur under your password or account. You agree to notify DevTalenty.com immediately of any unauthorized use of your password or account or any other security breach and to ensure that you exit from your account at the end of each session.

You may not use the Service for any purpose that is unlawful or that violates laws in your jurisdiction, in Costa Rica's jurisdiction, or in any way that intentionally or unintentionally infringes upon any applicable local, state, national, or international law.

Any software associated with the Services is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties.

Your Content and Data

We do not claim intellectual property rights over the data and material you provide to the Service. All uploaded materials remain yours.

"Data" refers to any data and content you upload, post, transmit, or otherwise make available through the Services, including messages you send, files you upload, comments you make on files, profile information, and anything else you enter or upload to the Service. DevTalenty.com will make commercially reasonable efforts to ensure that all facilities used to store and process your data meet high security standards.

To provide you with services, we require you to grant us certain rights regarding your Data. For example, we need to transmit, store, and copy your Data to display it to you and your collaborators, index it for searchability, create backups, etc. Your acceptance of these terms grants us permission to do so solely for the purpose of providing the Service. This permission allows us to use third-party service providers (e.g., Amazon Web Services, DigitalOcean) in the operation and administration of the Service, and the rights granted to us extend to these third parties as necessary to provide the Service. Depending on the service, this may involve moving your data across jurisdictions or country borders.

The Company will not share, disclose, sell, lease, modify, delete, or distribute any data you provide in any way.

The Company will also not view your Data except when you grant permission for support purposes.

You agree that DevTalenty.com may include your company's name in an online client list and printed or electronic marketing materials. If you prefer not to have your data included, please email us at DevTalenty.com.

Conduct on DevTalenty.com

You may not use the DevTalenty.com platform to:

• Upload, post, transmit, or make available any data that is illegal, harmful, threatening, abusive, harassing, illicit, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable.
• Upload or transmit images containing nudity, weapons, violence, or drugs.
• Impersonate or misrepresent your relationship with any person or entity.
• Upload or transmit any Content that you do not have the right to make available or that infringes on any patent, trademark, trade secret, copyright, privacy, or other proprietary rights of any party.

You are solely responsible for your interactions with other users. We reserve the right to monitor disputes between you and other users but have no obligation to do so.

We reserve the right to terminate any account that violates these terms.

Billing

You are not obligated to purchase any of the Services. If you choose to purchase Service packages or additional Services, you may provide a credit card or other payment mechanism selected by You.

You agree that the Company may charge Your credit card or other payment mechanism for all due amounts related to the Services, including service fees, subscription fees, or any other fees associated with your use of the Services. If there are recurring annual, monthly, or similar fees for your subscription, these fees will be automatically charged to the designated credit card during the registration process or subsequently designated to the Company at the beginning of the subscription period and at the start of each renewal period unless you terminate your subscription before the relevant period begins.

Prices for all Services are subject to change at any time. The company will make reasonable efforts to provide prior notice. Such notice may be provided at any time by posting the changes on the DevTalenty.com website or within the Service itself.

All payments authorized by you in your account are final. There are no refunds for your account, regardless of whether you use the Services or not.

Regarding your purchase and/or use of the Service, you may be subject to taxes, including but not limited to sales and use taxes. You agree that the obligation and payment of such taxes shall be your sole and absolute responsibility, and you agree to indemnify DevTalenty.com in relation to any obligations or liabilities arising from such taxes.

You agree that if we are unable to collect fees owed by you for the Services through your account, DevTalenty.com may take any necessary measures to collect such fees, and you will be responsible for all associated costs, including collection fees and legal costs. Additionally, you agree that the Company may charge interest at 1.5% per month or the highest amount permitted by law on any unpaid amounts past their due date.
