1. Acceptance of Terms

Use of the website www.devtalenty.com (the "Site") and the services of Dev Talenty (operated by PulpoLine; "Dev Talenty", "we", "our") is subject to these Terms and Conditions ("Terms"), which may affect your rights and responsibilities.

By registering, submitting your information through our forms, or checking the corresponding acceptance box, you declare that you have read, understood, and expressly accepted these Terms and our Privacy Policy. If you do not agree, please refrain from using the Site and from submitting your data.

2. Service description and relationship model

Dev Talenty is a technology talent outsourcing and connection company that facilitates the link between client companies and professionals who have been previously evaluated and technically validated. We recruit, evaluate, and contract developers and technology professionals located in Latin America to provide services to our client companies globally. Our service includes, among others:

• Receiving and evaluating professional profiles.
• Applying filters and technical tests, which may be supported by artificial intelligence tools.
• Selecting, hiring, and assigning professionals to our clients' projects.
• Ongoing management of the relationship between the professional, Dev Talenty, and the client.

The professional is hired by Dev Talenty (PulpoLine) under a services or outsourcing agreement to perform functions for the benefit of one or more of our clients. The commercial relationship with the client belongs exclusively to Dev Talenty. The professional acknowledges that their engagement is established with Dev Talenty and not directly with the end client, unless expressly agreed in writing.

3. Eligibility

To register and use our services, you must:

• Be of legal age according to the laws of your country of residence.
• Have the legal capacity to enter into binding agreements.
• Provide truthful, accurate, and up-to-date information.

4. Information you provide to us

When applying, you may provide us with information including, but not limited to: full name, phone number, email address, country of residence, nationality, LinkedIn profile, portfolio, salary expectations, résumé (work experience, education, certifications), and technical test results.

You are responsible for the accuracy of the information you submit. False, incomplete, or outdated information may result in your exclusion from our processes, without prejudice to any applicable legal actions. The processing of your data is governed by our Privacy Policy.

5. Technical tests and evaluation

As part of the process, you may be invited to take technical tests aimed at objectively validating your knowledge in the language or technology described in your profile, including syntax, practical application, and theoretical concepts. You agree that:

The results of such tests form part of your evaluation and serve as a reference guide for your technical competencies, without necessarily being exclusively determinative.

We may use automated tools and artificial intelligence to support the filtering, organization, and evaluation of profiles and tests.

Final decisions on presenting candidates to clients are supervised by our team. You have the right to request information about the use of these systems in accordance with the Privacy Policy.

6. Acceptable use of the Site

You agree to use the Site in an ethical and responsible manner, respecting fundamental principles of good conduct. In particular, you agree not to:

• Submit third-party information without their authorization.
• Impersonate another person.
• Use the Site for fraudulent or unlawful purposes.
• Attempt to breach the security of the Site or access other users' data.
• Upload content that infringes third-party intellectual property rights.

We reserve the right to take appropriate measures, including suspension or cancellation of your account, in response to any inappropriate conduct, abuse, or activity that violates these Terms. All management, opportunity communications, and profile reviews must occur exclusively through the channels designated by Dev Talenty, in order to ensure transparent management and avoid issues arising from interactions outside that environment.

7. Intellectual property

The Site, its content, brand, logos, design, and materials are the property of PulpoLine or its licensors and are protected by applicable laws. The information you submit remains yours; by submitting it, you grant us a limited license to process it for the purpose of providing you the service, in accordance with the Privacy Policy.

8. No guarantee of placement

Dev Talenty does not guarantee that you will receive offers, interviews, hiring, or assignment to a client. Participation in our processes does not constitute a job offer nor does it create any right against Dev Talenty or its clients until an express contract is signed. We also reserve the right to reject profiles or offers that do not meet minimum market standards or the conditions of our processes.

9. Non-circumvention and exclusivity of the client relationship

The client companies, opportunities, and contacts you access through Dev Talenty are the result of our management and constitute an asset of Dev Talenty. You agree not to establish, negotiate, or maintain direct commercial or employment relationships with a client to whom you were introduced or assigned by Dev Talenty, bypassing, omitting, or replacing Dev Talenty, during the relationship and for a reasonable period thereafter, unless expressly authorized in writing by us. Breach of this clause may give rise to the actions and claims that apply.

10. Confidentiality

During and after your relationship with Dev Talenty, you agree to maintain the confidentiality of all non-public information relating to Dev Talenty, its clients, projects, processes, rates, and methodologies to which you have access, and not to use it for purposes other than providing the services.

11. Site availability and support

We have a support team to handle inquiries and provide assistance. On certain occasions, we may temporarily restrict access to the Site for repair, maintenance, or to introduce new features or services, working to restore service as soon as feasible. We do not guarantee that the Site will be available uninterrupted or error-free.

12. Limitation of liability

To the extent permitted by law, PulpoLine shall not be liable for indirect, incidental, or consequential damages arising from the use of the Site or services. Our liability is limited to acting in good faith and with diligence in providing the service.

13. Links and third-party services

The Site may contain links or integrations with third-party services (for example, evaluation platforms). We are not responsible for the content or privacy practices of such third parties.

14. Modifications

We may modify these Terms at any time and unilaterally. We will publish the updated version on the Site with its date and notify you of significant changes. Continued use of the Site or our services after publication constitutes acceptance of the changes.

15. Termination

We may suspend or cancel your access immediately in the event of breach of any of your obligations under these Terms. You may request deletion of your profile at any time in accordance with the Privacy Policy.

16. Applicable law and jurisdiction

These Terms are governed by the laws of the Republic of Costa Rica. Any dispute shall be submitted to the competent courts of Costa Rica, without prejudice to the rights granted to you by law in your country of residence.
